1.0 General

1.1          These terms and conditions will apply to all transactions placed by email, telephone or by post with Outdoor Academy. Please read carefully before booking.

1.2          All contracts shall be governed by and construed in accordance with English Law and any dispute between us will be resolved exclusively in the courts of England and Wales. Nothing in these terms and conditions will be deemed to affect your statutory rights.

1.3          All transactions with Outdoor Academy will be governed by these terms and conditions.

1.4          These terms and conditions contain important information regarding client participation and accordingly, clients acknowledge and agree that all members of the party are aware of and accept these booking terms and conditions.

1.5          All references to the ‘company’, ‘us’ or ‘we’ will refer to Outdoor Academy. All references to the customer shall mean the person or persons purchasing or agreeing to purchase goods or services from the company.

 

2.0 Fees and Booking Confirmation

2.1          All prices are shown in pound sterling (£) and are inclusive of UK VAT at the current rate unless clearly stated otherwise. All prices are subject to change without prior notice.

2.2          A non-refundable deposit of 50% of the total cost is payable to confirm the booking.  In the event that the deposit is not paid Outdoor Academy will have the discretion to treat the booking as cancelled by the client and re-sell the date(s) available.

2.3          The balance of the fee is payable 4 weeks prior to the commencement of the date unless otherwise agreed. In the event that the balance is not paid Outdoor Academy will have the discretion to treat the booking as cancelled by the client and re-sell the dates available.

2.4          The whole booking fee is required for any booking made within 4 weeks of the commencement of the event date.

2.5          The deposit and balance payment will be payable to Outdoor Academy by cheque or BACS payment.

2.6          Clients must advise Outdoor Academy of any mistakes or changes required to the booking confirmation as soon as possible.

 

3.0 Cancellation by Client

3.1          All cancellations must be notified to Outdoor Academy in writing by letter or email as soon as possible.

3.2          In the event that the booking is cancelled by the client prior to the commencement of the intended event date, the client will not be refunded the 50% deposit.

3.3          In the event that the booking is cancelled by the client prior to the commencement of the intended event date, the client will be charged the following cancellation fees:

75% of the total booking fee where cancellation takes place between 2-4 weeks before the commencement of the intended event date;
100% of the total booking fee where cancellation takes place within the final 2 weeks before the commencement of the intended event date.

3.4          In the event that a refund is required, the agreed amount will be paid to the client by cheque only and will only be made after the first confirmed date has commenced.

 

4.0 Cancellation by Outdoor Academy Ltd

4.1          Outdoor Academy shall be entitled to cancel a booking at any time.  Outdoor Academy will notify the client of cancellation as soon as possible and a full refund will be given in the event of cancellation under this cause.  No other compensation shall be payable.

4.2          Outdoor Academy shall notify the client of cancellation prior to the commencement of the event date where numbers as a result of client(s) cancellation failed to reach a workable minimum for the commencement of the booking.

4.3          Cancellation by Outdoor Academy does not affect a client’s right to a refund of travel costs that he/she may have incurred prior to the cancellation and since lost except in the circumstances set out in clauses 4.1 or 4.2.

4.4          In the event that a refund is required, the agreed amount will be paid to the client by cheque only.

 

5.0 Unforeseen Circumstances

5.1          For your safety, we may be required to change/amend or cancel any activity due to unforeseen circumstances beyond our control including, but not limited to, adverse weather conditions, equipment failure, site accessibility and suitability of terrain.  Where possible we will endeavour to notify you in advance of the intended event date.  In this situation, no refund will be offered.

5.2          In the event of traffic or other uncontrollable circumstances affecting our arrival to the event on time and we are unable to fulfil our contractual obligations, we will endeavour to reach a mutual agreement with the client however the maximum refund will be 10% of the total cost.  The deposit will not be refunded and other compensations will not be provided.

5.3          In the event that the client requests a change to a confirmed activity, this must be done so in writing by letter or email at least 48 hours prior to the event.  It is at the discretion of Outdoor Academy to approve the change of activity.

 

6.0 General Activity Booking Conditions

6.1          In the event that any working environment for Outdoor Academy staff or participants becomes unsafe, we reserve the right to suspend the activity until rectified including, but not limited to, adverse weather conditions.

6.2          We reserve the right to refuse admittance to any activity in line with our Operating Procedures and Risk Assessments.  No refund will be given.

6.3          Safety is of paramount to Outdoor Academy.  All participants are required to obey the rules and instruction from all members of Outdoor Academy staff at all times and act in a way that would not prevent others from taking part in the activity.  We reserve the right to refuse admittance on these grounds.

6.4          Participants must not be under the influence of alcohol or drugs during any activity. We reserve the right to refuse admittance on these grounds.
6.5          Outdoor activities can be hazardous. Participants must be aware of and accept this risk and be responsible for their actions and involvement. In the interest of client safety and the safety of others, clients must ensure they are prepared for the activity and working within their limitations.

6.6          For adult bookings, we shall require current medical information for all participants taking part in the activities prior to the commencement of the event date.  Outdoor Academy will provide the Medical Consent Form.

6.7          For school or youth bookings, we shall require current medical information and parental permission for all participants taking part in the activities prior to the commencement of the event date.  Outdoor Academy will provide the Medical Consent Form.

6.8          In the event of damaged or loss of pre-booked equipment, we reserve the right to hire equipment from reputable suppliers or other activity providers with equipment of a similar type and value.

6.9          We accept no responsibility for loss or damage to personal property belonging to participants.

6.10        For safety reasons, all participants must be able to understand spoken English or have translators.

6.11        We operate a ‘Leave No Trace’ policy however we accept no responsibility to any ground or surface damage caused by our equipment or vehicles.

6.12        It is the responsibility of the client to ensure that all participants arrive in sufficient time for the start of the activity programme.  No refunds or compensation will be payable to late arrivals.  The activity programme may be altered to coincide with any alternative arrival time to that stated on the programme.

6.13        All clients are required to wear safety equipment provided by Outdoor Academy and must not be tampered with once checked.
